Acceptance of Terms
By accessing the DNA Labs Kenya website or ordering any genetic-testing service (“Test”) from DNA Labs Kenya (“Company,” “we,” “our”), you (“Client”) agree to be bound by these Terms & Conditions, which supersede any other oral or written arrangement.
Educational-Only Website
All website content, tools, and reports are supplied strictly for education and research; nothing on the site constitutes medical, legal, or diagnostic advice and no legally enforceable rights arise from using the site or our reports.
Definitions
- “Client” – private individual, business, or entity ordering a Test
- “Service” – any DNA or genetic test advertised by the Company
- “Price” – current list price at time of order
- “Nominated Person” – individual designated to receive results
Ordering & Payment
Submitting an online form, email, phone request, or in-person booking constitutes an offer to purchase Services; acceptance occurs only after full payment is received. Prices include collection kit, laboratory analysis, and electronic report unless stated otherwise.
Sample Collection & Handling
Clients are responsible for obtaining samples lawfully and for providing complete, legible documentation; failure to do so may delay or invalidate results and no refund will be due. Remaining biological material may be destroyed in line with laboratory SOPs after analysis.
Test Limitations & No Warranty
- Genetic testing, while highly accurate, can yield inconclusive or erroneous outcomes due to sampling error, rare variants, or technical issues.
- The Company gives no guarantees or warranties—express or implied—of completeness, accuracy, merchantability, or fitness for a particular purpose of any Test, report, or website content.
- No assurance is given that third parties (courts, insurers, regulators) will accept or interpret results in any particular way.
Liability Limitation
To the fullest extent permitted by law, the Company’s total liability for any claim—whether in contract, tort, negligence, or otherwise—shall not exceed the amount paid for the specific Test giving rise to the claim. We are not liable for indirect, incidental, or consequential damages arising from use or inability to use our Services or reports.
Turnaround Times
Estimated reporting times are indicative and not guaranteed; delays caused by courier issues, sample degradation, or force majeure do not give rise to refunds or damages.
Results Delivery & Use
Electronic reports are issued to the Nominated Person via secure email unless otherwise arranged. Clients assume full responsibility for how results are interpreted or disclosed to third parties.
Intellectual Property
All content, logos, and laboratory methodologies remain the intellectual property of DNA Labs Kenya; reproduction or commercial exploitation without written consent is prohibited.
Client Responsibilities
Clients warrant that:
- All information provided is correct and lawful.
- They have authority to submit each sample and to receive the resulting data.
- They will indemnify the Company against claims arising from illegal or unauthorised sampling.
Cancellation & Refunds
Refunds are governed by a separate Refund Policy; once laboratory processing begins, no monetary refund is available except where an internal laboratory error prevents a result.
Privacy & Data Protection
Personal data, including genetic data, are processed under our Privacy Policy; data subjects may request access, correction, or deletion as permitted by law.
Refusal or Termination of Service
We reserve the right to refuse or cancel Services if samples appear illegally obtained, results might be used for improper purposes, or a conflict of interest exists.
Governing Law & Dispute Resolution
These Terms are governed by the laws of Kenya. Parties agree to attempt amicable resolution; failing that, disputes shall be submitted to the competent Kenyan courts.
Amendments
DNA Labs Kenya may revise these Terms at any time by posting an updated version online. Continued use of the site or Services after changes are posted constitutes acceptance of the revised Terms.
